HOTAA Rules


(1) This is a "DEALERS ONLY" auction. All Dealers must be registered and approved by the auction before buying and selling can be permitted.

(2) Any Buying or Selling of vehicles on the premises must be transacted through the office. Disregard of this rule will result in termination of business at the Heart of Texas Auto Auction.

(3) Auction is not responsible for odometers. The Auction does not make any presentation regarding mileage of any vehicle. All vehicles that are 10 years and older will be sold as "Exempt" mileage does not relieve the seller from announcing prior odometer discrepencies. The auction assumes that vehicles which read "Exempt" are to have over 100,000 miles regardless of odometer reading. On all vehicles that are less than 10 years of age, mileage over 100,000 miles or any other mileage discrepancy must be announced on block. Mail on vehicles with 5 digit odometers will read mileage with possible "EML" (Exceeds Mechanical Limits). It is the responsibility of the seller to determine the respective mileage to be announced.

(4) The Auction reserves the right to sell any unit if the bid is written $50 of the stated reserve price.

(5) The Auction is not a party to the contract of sale, which is between the seller and the buyer only. All warranties are those of the seller only. The Auction makes no warranties, implied or expressed.

(6) If a seller materially misrepresents a vehicle which is turned down, the seller will be responsible for all charges and sales fees. Sellers shall be subject to a voided sale charge equal to sellers fee, regardless of reason.

(7) Titles which have been assigned to Heart of Texas Auto Auction will not be accepted, as we are not a party to the transaction. Sale may be canceled at the buyers discretion if the title is not received by the auction within 30 days. The buyer must notify the auction within a 24 hour period prior to the return of the vehicle. Seller will be assumed all auction fees and buyers transportation expenses. After the initial sale of unit on sale night, for whatever reason the transaction is voided, all sellers fees will be collected - NO EXCEPTIONS!

(8) Buyers are cautioned to spend no money or to sell any vehicle without a title. The auction will not be held liable for any expenses on vehicles returned for "no title" or turned down for any reason.

(9) The auction does not guarantee make, model, year, mileage, mechanical condition, or float-ability on boats, motors, motorcycles, or RV's. These units are sold "As-Is" where is.

(10) Seller is responsible to ensure the year, make, model, and odometer information written on the vehicle and the mail are correct. Additionally, seller is also responsible for all announcements on the block.

(11) All vehicles that are registered to the sale are done so at the seller's risk. Heart of Texas Auto Auction is not responsible for theft, collision, fire, vandalism, damage, or acts of nature which could not be prevented.

(12) Regardless of selling description, the following units MUST be announced:
*Frame Damaged Units *Cracked Block *Flood Cars *Motor Change Outs
*Rebuilt Units *Police Cars *Taxi Cabs *Reassigned Vins *Reconditioned
*Salvage Title *Diesel Conversion *Core Damage *Odometer Problems *Bonded Titles

Dealer has Seven Days from date of purchase to notify HOTAA staff of frame damage and or prior frame damage. After seven days the vehicle CAN NOT be returned, No Exception.

(12a) Recon Titles - If you purchase a unit with a recon title, buy it with the assumption that it has been under water, cut in half and welded back, been totaled out and super glued back together. Anticipate the worst when you purchase a recon unit!

(13) The Auction does not guarantee series on European Conversions (Grey Market) or any foreign unit which does not comply with federal regulations.

(14) Any vehicle left on the premises in excess of 30 days will have a lien put against it and will then be sold for storage charges. Dealer may or may not be notified.

(15) Any dealer who refuses to honor a draft of a check to Heart of Texas Auto Auction without prior approval from management will be placed on "STOP" immediately and reported to the Auction Insurance Agency.

(16) Any car proven to have odometer tampering is cause for return at the seller's expense and will be reported to the Motor Vehicle Division.

(17) All cars leaving the auction must have a gate pass to exit the premises.

(18) The auction does not guarantee emission control devices, buyer must check before bid.

(19) The normal time limit on a "WITH CALL" sale is 24 hours, however the auction will continue to work on the "WITH CALL" sales until the sale is canceled by the buyer and after 24 hours. Buyers must notify the auction of his intent to purchase or void the sale.

(20) Vehicle transportation arrangements are the sole responsibility of the dealer. The auction is not a party to the contract between the dealer and the outsider transporter.

(21) Buyer assumes all responsibility or damage to unit when test driving off premises regardless if it is a "WITH CALL" or a "SOLD UNIT".
